Insurance Gov. Gavin Newsom released budget trailer language last week that sets de- fined timelines for submitted insurance industry rating plans to be approved or commented on by the California Department of Insurance. The insurance sector supports the bud- get trailer bill. Consumer Watchdog—the sole intervenor that challenged 18 differ- ent rate plans submitted by insurers last year—has already said it will bring legal challenges seeking to block the law from being implemented if it is signed in its cur- rent form as part of the governor’s budget. To address the insurance crisis, state Senate President Pro Tempore Mike McGuire, D-Healdsburg, appointed a nine-member Senate Insurance Working Group co-chaired by state Sen. Susan Rubio, D-Baldwin Park, and state Sen. Lena Gonzalez, D-Long Beach. The new panel includes state Sen. Marie Alvarado-Gil, D-Jackson, who authored legislation sponsored by the California Farm Bureau that aims to improve the understanding of the health impacts of wildfire smoke and enhance the state’s ability to mitigate these impacts through data-driven approaches. The measure, Senate Bill 945, passed in the state Senate with unanimous support and moved to the Assembly. Other members of the state Senate panel include: Catherine Blakespear, D-Encinitas; Bill Dodd, D-Napa; Dave Cortese, D-San Jose; John Laird, D-Santa Cruz; Monique Limón, D-Santa Barbara; and Steve Padilla, D-San Diego. The working group asked California Farm Bureau to provide testimony at its first meeting. The creation of the working group fol- lows calls by Newsom for legislative ac- tion on insurance. The Assembly has yet to organize a similar insurance group. But as long as the insurance market remains in crisis, it is reasonable to presume that elected officials are going to be hearing from constituents. When a business’s deductions and losses exceed its income from all sources in a tax year, it may have a net operating loss. This deduction allows businesses to offset future taxable income by carrying back losses to the past years or carrying them forward to future tax years. California suspended the deduction during the pandemic and restored it last year. The Assembly and Senate last week published a response to the governor’s budget revision that accepts the deduction suspension with an earlier timeline, recom- mending that the suspension and cap be in place for tax years 2024, 2025 and 2026.
Pesticide Regulation budget change pro- posal related to the mill tax on pesticide sales. DPR has been seeking to raise the mill tax from 21 mills to 28.6 mills during a three-year period. Along with significant increases in registration and licensing fees, the plan would amount to a $33 million tax increase statewide. Members of the subcommittee said the DPR proposal should be considered and vetted through related legislation, Assembly Bill 2113 by Assembly Member Eduardo Garcia, D–Coachella. The bill, which seeks to establish a Sustainable Pest Management Workgroup within the
agency, is in the policy committee process and has been amended multiple times. AB 2113 is due to be heard in the state Senate environmental quality and agri- culture committees, and Farm Bureau will continue to be engaged on the matter. Taxation California Farm Bureau joined the California Taxpayers Association and busi- ness groups in opposing language in Gov. Newsom’s May budget revision that would suspend until 2027 the net operating loss carryover deduction for businesses that earn more than $1 million.
